  • Q: How long does probate take in Pennsylvania?

A: Probate timelines vary based on estate complexity, disputes, and asset types.  The law provides that Inheritance Tax must be paid within 9 months of the date of death.

  • Q: What are the duties of an executor?

A: An executor must administer assets, pay debts, file taxes, and distribute property according to law.

  • Q: Can a will be contested?

A: Yes. Under certain circumstances, wills may be challenged in court.

  • Q: What if beneficiaries disagree?

A: Disputes may require legal resolution through court proceedings.  Court proceedings typically result in the administration of the estate take much longer.  It benefits everyone if an agreement is reached.  Agreements typically result in less legal fees.

  • Q: When should I contact an attorney after a death?

A: As early as possible, especially when assets, disputes, or legal questions exist.

  • Q: Who should be the Administrator of an Estate when the decedent had no Will?

A: Unless individuals are otherwise unqualified, preference is given to immediate family members first.
