FAQ – Personal Injury

Personal Injury FAQ

1) What should I do right after an accident?
Get medical help first. If you can, report the incident, take photos, get witness names, and keep records (medical visits, receipts, time missed from work).

2) How long do I have to file a claim?
There are deadlines (called “statutes of limitations”) and they can be strict. The deadline depends on your state and the type of case.  In Pennsylvania, you generally have two (2) years to initiate a negligence claim unless the claim is against a government entity (in which case you must take action within 6 months).

3) Do I have a case?
If someone else’s carelessness caused your injury, you may have a claim. A lawyer can review the facts and explain your options.

4) What if the insurance company calls me?
Be careful. Insurance adjusters may ask for recorded statements or quick settlements. It’s usually smart to speak with a lawyer before giving detailed statements.

5) Will my case settle or go to court?
Many cases settle, but some go to court if there’s a dispute about fault or the value of the claim.

6) How much is my case worth?
It depends on your medical care, missed work, how the injury affects your life, and who is responsible. Every case is different.

7) Do I have to pay a lawyer upfront?
Some injury cases are handled on a contingency fee (fees come from any recovery). Other arrangements are possible. Ask for the fee agreement in writing.

8) How long will my case take?
Some cases resolve in months. Others take longer, especially if medical treatment is ongoing or if a lawsuit is filed.
